Terms & Conditions – Practicing Hypnotherapists

DEFINITIONS

The ‘Practitioner’ is the Hypno-EMDR Practitioner certification holder.

The ‘Owner’ is Dr Kate Beaven-Marks.

‘Practice’ refers to the Hypno-EMDR Association business entity.

‘HEMDRA member’ is the ‘Practitioner’ and vice versa.

These terms and conditions are governed by and interpreted according to English law. All disputes arising under these terms and conditions are subject to the exclusive jurisdiction of the English courts.

INFORMATION REQUIRED FOR HEMDRA MEMBERSHIP

Applicants for HEMDRA membership agree to provide the following information before practicing under the HEMDRA Practitioner brand and HEMDRA membership and agree to provide the following.

  • Evidence (eg photo) of Diploma or equivalent in hypnotherapy or clinical hypnosis.

  • Completion of the Hypnosis-Courses.com Hypno-EMDR online course and a pass mark (80% of higher) in the Practitioner exam.

INFORMATION REQUIRED TO BE LISTED IN THE PRACTITIONER DIRECTORY

HEMDRA members can apply to be listed in the Practitioner Directory. The following are required:

  • Proof of professional indemnity and public liability insurance of £1million or the international equivalent and kept up to date.

MEMBERSHIP TERMS & CONDITIONS

Duration and fees

  • Membership is granted for one year.

  • The membership will automatically renew unless cancelled by the member.

  • Should an increase in membership fees be required, this will be communicated to members at least 30 days prior to any increase.

Practitioner Directory

  • To remain listed in the Practitioner Directory, a member is required to maintain appropriate insurance (as previously detailed).

  • A practitioner is expected to meet the continuing professional development (CPD) requirements of their primary hypnotherapy professional association, and be able to evidence a minimum of 15 hours of relevant CPD.

  • A practitioner can request removal or updating of information at any time.

Scope of practice

  • Practitioners agree to work within their competence at all times and in accordance with the rules for practice in their country, state or territory.

  • Practitioners are fully responsible for their conduct and their client’s welfare. They agree to being one hundred percent solely responsible for the management, settlement and outcome of any client or third-party disputes or litigation.

Conduct and integrity

  • Practitioners agree to act ethically, honestly and truthfully when communicating with colleagues, clients, patients and members of the public. This includes when discussing the scope of their training, and when using the Hypno-EMDR protocol, techniques and approaches.

  • In relation to trauma and other issues that Hypno-EMDR is applied to, Practitioners agree to avoid the use of the word ‘cure’ in their advertising materials and when working with clients.

  • Practitioners agree to comply with all relevant legislation, including but not limited to legislation relating to health and safety, and data protection.

Resources and materials

  • Practitioners agree to not distribute any HEMDRA material, documents or correspondence outside of the HEMDRA network.

Training licences

  • Practitioners agree to not use the Hypno-EMDR course and HEMDRA resources to create and/ or sell a Hypno-EMDR training course for therapists or as a self-help resource. This applies to any form including electronically, video and written form.

  • Practitioners agree to not sell any HEMDRA resources they receive.

  • When training licences are available, practitioners can apply to be a trainer.

HEMDRA member logo and branding

  • Practitioners agree to only use the HEMDRA Member logo when entitled to use it as a current member.

  • Practitioners agree to use the HEMDRA Member logo as supplied, without alteration.

Facebook community

Practitioners agree to conduct themselves professionally and respectfully when associating with other HEMDRA members.

Cessation of membership

  • Practitioners agree that should a breach of these terms and conditions, or any behaviour or conduct lead to a professional or ethical breach, that this will lead to HEMDRA suspending the practitioner’s membership, pending investigation.

    • Such an investigation would provide the member with an opportunity to submit evidence or argument as appropriate in response to the issue.

    • The ultimate decision lies with Dr Kate Beaven-Marks, founder of HEMDRA.

  • Should a practitioner cease to be a member, for any reason, they agree to remove all uses of the HEMDRA logo and written information relating to membership. This applies to digital and print communications, such as websites and leaflets.

Practitioners agree to respect the rights of founder Dr Kate Beaven-Marks as the sole owner of HEMDRA content. This excludes the content which is attributed to others.
